These Terms of Service (“Terms”) govern your access to and use of radiantbarrierusa.com (the “Site”), operated by Radiant Barrier USA (“we”, “us”, “our”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. About the Site

The Site is informational and lead-generation. We manufacture reflective insulation and vapor barrier products and connect visitors with authorized dealers. The Site does not process direct retail sales. Quotes, orders, and delivery are arranged through our authorized dealers or by contacting our team directly.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to submit a quote request, dealer application, or any other form on the Site. By submitting a form, you represent that the information you provide is accurate and that you are authorized to submit it.

3. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the Site, server, or related systems
  • Use automated tools (bots, scrapers, crawlers) to collect data from the Site without our written permission, except for compliant search engine indexing
  • Interfere with the Site’s operation, security, or availability, including by sending excessive traffic
  • Submit false, misleading, or fraudulent information through any form
  • Upload or transmit malicious code, viruses, or harmful content
  • Reverse engineer or attempt to derive the source code of any part of the Site

4. Product and Performance Information

We work to keep product descriptions, specifications, R-values, fire ratings, and reflectivity claims accurate and up to date. Performance values are based on third-party testing of properly installed product under standard conditions and may vary with installation quality, climate, and application. Diagrams and photographs are illustrative.

We reserve the right to correct errors, update specifications, change product availability, and discontinue products at any time without notice. Always review the current product spec sheet and confirm with our team or your dealer before specifying or purchasing.

Nothing on the Site is engineering advice for a specific building. For project-specific recommendations, consult a qualified architect, engineer, or building official.

5. Quotes, Dealers, and Orders

When you submit a quote request or use the dealer locator, we may pass your contact information and project details to one or more authorized dealers so they can follow up with you. Any sale, delivery, warranty, return, or installation is governed by the terms of the dealer or installer you transact with, and is not a contract between you and Radiant Barrier USA unless we expressly enter into one in writing.

If you purchase product directly from Radiant Barrier USA under a separate written agreement, that agreement governs your purchase, including warranty and limitation of liability terms. These Terms govern your use of the Site only.

6. Warranty Disclaimer

The Site and all content (text, images, specifications, downloadable spec sheets, calculators, articles, and tools) are provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses, or that any information on the Site is current, accurate, or complete.

Product warranties, where offered, are stated in the product spec sheet or warranty document for that product and are separate from these Terms.

7. Limitation of Liability

To the maximum extent permitted by law, Radiant Barrier USA, its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Site will not exceed one hundred US dollars (US $100), or, if you have purchased product directly from us under a separate written agreement, the amount you paid us for the product giving rise to the claim, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Intellectual Property

All content on the Site, including text, images, logos, product names, icons, downloadable documents, source code, design, and the overall look and feel, is owned by Radiant Barrier USA or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.

You may view, download, and print Site content for your personal, non-commercial use, or for your internal business use of evaluating our products. You may not otherwise reproduce, modify, distribute, publicly display, sell, or create derivative works from the content without our prior written consent.

“Radiant Barrier USA” and our product names and logos are our trademarks. All other trademarks belong to their respective owners.

9. User Submissions

If you submit a question, comment, testimonial, photograph, or other content to us through the Site, email, or social media, you grant Radiant Barrier USA a worldwide, royalty-free, non-exclusive, perpetual, sublicensable, irrevocable license to use, reproduce, adapt, and display that content in connection with our marketing and operations, with attribution where appropriate. You represent that you own or have the rights to the content you submit and that it does not violate any third-party rights or law.

The Site links to third-party websites (dealer sites, technical references, social media, Google Maps). We do not control and are not responsible for the content, privacy practices, or terms of those sites. Your use of third-party sites is at your own risk and subject to their terms.

11. DMCA / Copyright Complaints

If you believe content on the Site infringes your copyright, send a written notice to info@radiantbarrierusa.com including: (a) identification of the copyrighted work, (b) the URL of the allegedly infringing content, (c) your contact information, (d) a statement that you have a good-faith belief that the use is not authorized, (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the copyright owner, and (f) your physical or electronic signature.

12. Indemnification

You agree to indemnify and hold harmless Radiant Barrier USA and its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or for any other reason. Sections that by their nature should survive termination (including Sections 6, 7, 8, 9, 12, 14, and 15) will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts. Each party waives any right to a jury trial. Any claim must be brought within one year after the cause of action arises, or it is permanently barred.

15. Changes to These Terms

We may update these Terms at any time. The “Last updated” date at the top reflects the most recent revision. If we make material changes, we will post a notice on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

16. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Radiant Barrier USA regarding the Site, and supersede prior agreements on the same subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
